AS the dust settles on the government’s latest tax changes, it’s worth taking a closer look at one of the more unexpected reforms and its likely consequences.<\/p>\n

Much has been written about changes to negative gearing and capital gains tax, but one change has received far less attention: the new restrictions on purchasing residential property through a self managed superannuation fund (SMSF).<\/p>\n

In our view, this is one of the more significant policy changes, not only because of what it prevents, but because of the unintended consequences it may create.<\/p>\n

What has changed?<\/p>\n

The Albanese government, with the support of the Greens, has legislated changes that prevent SMSFs from using borrowed funds to purchase residential property in new arrangements.<\/p>\n

Existing loans are grandfathered, so they are unaffected, but future purchases using this structure are no longer possible.<\/p>\n

The government has argued that fewer than 1 per cent of residential property purchases are affected.<\/p>\n

While that may be true, the impact of this change has not been thought through by the government, and the broader impact is likely to be felt elsewhere.<\/p>\n

Many residential developments rely on pre-sales before construction finance is approved.<\/p>\n

Developers are often required to secure a certain number of contracts and deposits before a bank will release funding to build an apartment complex or housing estate.<\/p>\n

SMSF buyers have traditionally been an attractive part of this market because they often have substantial cash balances and are generally comfortable having funds held in trust until construction is complete.<\/p>\n

Reducing this pool of buyers will likely make it harder for developers to achieve the pre-sales needed to commence construction, further slowing the delivery of new housing at a time when Australia is already facing a significant undersupply.<\/p>\n

Where is the opportunity?<\/p>\n

Every policy change creates winners and losers, and investors should always be asking where the opportunities now lie.<\/p>\n

One area that may become increasingly attractive is commercial property.<\/p>\n

Smaller commercial assets, such as neighbourhood cafes, medical suites, hairdressers or local retail shops, can still be purchased within an SMSF using bank finance.<\/p>\n

For investors seeking diversification and long-term income, these assets may become a more compelling option.<\/p>\n

The residential market also continues to present opportunities outside of SMSFs.<\/p>\n

While some tax incentives have been reduced, the fundamental supply and demand imbalance remains.<\/p>\n

Australia is still not building enough homes to meet population growth, and until that changes, there is likely to be ongoing upward pressure on property values over the long term, despite the short to medium-term challenges.<\/p>\n

Play the long game<\/p>\n

The reality is that governments will continue to change tax policy over time, often with unintended consequences.<\/p>\n

The most successful investors aren’t those who chase the latest tax concession, but those who build a long-term strategy based on quality assets, sensible borrowing and clear financial goals.<\/p>\n

Tax outcomes should support an investment decision, not drive it.<\/p>\n

When the fundamentals remain strong, opportunities will continue to exist, regardless of which party is in government.<\/p>\n
